Taking into account the current Federal Constitution, it can be seen that there is greater protection for the various family models, which can be understood not only as those established by a man and a woman, in their traditional model, but also those constituted by a single person (monoparental), only by one of the parents and their descendants and the homoaffective (the focus of this work). Because of this, it is important to establish rules in order to protect the rights of the people involved, both in life and in death. This research will address issues involving the rights that exist in same-sex relationships. It is structured in three chapters that will explain in a concise, coherent and objective way what homosexuality is, how Brazil deals with these relationships and, finally, how the succession rights of the surviving partner will be dealt with. This will show that these relationships have the same rights as those recognised for heterosexuals, without any discrimination, thus respecting what prevails in our current Constitutional Charter.
