The Responsibility of Land Managers in the D.R.C.

The Registrar of Real Estate Titles should have a special profile that enables him to fulfill his triple mission (i.e. political, administrative and patrimonial) ...because he is privileged compared to other Division Heads. This is why the Conservateur has precedence over his Cadastre colleague, even though they both work in the same land district. It all stems from the fact that the legislator wanted the State to be responsible for any errors this official may make in the performance of his duties. This is the stumbling block! Why did the legislator want to place the curator under a legal protection regime?Given that the State is liable for errors committed by the curator in the context of civil liability, it is not true that it protects him or her in the context of criminal liability.
